Terms of Use

These Terms of Use govern your access to and use of the QSKing website (qsking.com) and the QSKing Revit plugin (“the Software”). By downloading, installing, or using the Software, you agree to these terms.

1. Licence

QSKing grants you a non-exclusive, non-transferable licence to install and use the Software on the number of devices specified in your subscription plan, subject to these Terms.

The free trial licence is valid for 30 days from the date of download and includes full access to all features. After 30 days, continued use requires a paid subscription.

2. Restrictions

You may not:

  • Copy, modify, distribute, sell, or sublicence the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Share your licence key or login credentials with others
  • Use the Software for any unlawful purpose
  • Remove or alter any proprietary notices in the Software

3. Intellectual property

All intellectual property rights in the Software, including the extraction algorithms, Workbook engine, delta engine, and user interface, are owned by QSKing. Nothing in these Terms transfers any intellectual property rights to you.

4. Third-party software

The Software runs as a plugin within Autodesk Revit. Use of Autodesk Revit is subject to Autodesk’s own licence terms and subscription. QSKing is an independent product and is not affiliated with, endorsed by, or sponsored by Autodesk, Inc. Autodesk and Revit are registered trademarks of Autodesk, Inc.

5. Disclaimer of warranties

The Software is provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. QSKing does not warrant that the Software will be error-free or uninterrupted.

Quantities extracted by the Software are based on the geometry and parameters in the Revit model at the time of extraction. The user is responsible for verifying extracted quantities and for applying professional judgement in the preparation of any bill of quantities, cost plan, or estimate.

6. Limitation of liability

To the maximum extent permitted by law, QSKing’s total liability to you for any claim arising from your use of the Software shall not exceed the total amount paid by you to QSKing in the twelve months preceding the claim. QSKing shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits or data.

7. Subscription and payment

Subscriptions are billed in advance on a monthly or annual basis. All prices are in Australian Dollars (AUD) unless otherwise stated and are exclusive of GST where applicable.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Annual subscriptions are non-refundable after 30 days from the date of purchase.

8. Termination

QSKing may suspend or terminate your licence immediately if you breach these Terms. Upon termination, you must cease all use of the Software. Clauses 3, 5, 6, and 9 survive termination.

9. Governing law

These Terms are governed by the laws of Australia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
